What to do if my child's mother failed to keep an agreement to have me removed from child supprot?
Question Details: The agreement was that she would remove me from child support and return all payments received back to me. My son came to live with me over 3 months ago. As to date I have not not been removed from child support, have not received any of my child support payments back, and not received any financial support at all. I live in My son's mother and I made a deal that I would keep him this school year while she rehabilitates herself from having a another baby. What can I do? What would be the best plan of action for me?
I suggets that you prepare a child support modifivcation agreement and order (or have a family law attorney do such for you) and send it to your child's mother for signature and return.
If she fails to date, sign and return it to you in a reasaonable time period, your legal options seem to be to file a petition with the court seeking to modify the current child support order that you are under for the reasons stated in your question.
