Can my fiance adopt my son without his biological father's permission considering we have no contact with him or a way of even finding him?
Question Details: Or do we have to be married first? My son is almost 6 years old and the last time I saw or heard from his father I was 5 months pregnant with my son. All I know is that he's somewhere in another state. Also, the biological father's name is not on the birth certificate. It says "unknown" under the father section since he wasn't around.

Your fiance is able to adopt the child without the birth-father's consent. You would have to make a good faith effort to locate him, and then the court would allow substituted service - often by publication in a newspaper. Your attorney can help you with this process.
