My son has not worked in 5 years and cannot pay child support, will he got to jail?

Question Details:

My son was ordered to pay child support, having not had a job in 5 years due to PTSD and panic attacks. We had a psychological evaluation from a state appointed psychologist that said he needed medical amelioration before he could work. He has not been able to pay and now he has a child support contempt hearing and we have no money for an attorney. If he asks for a court appointed attorney, will the hearing be continued?

Your son needs to consult an attorney in his area regarding filing a modification of child support. He may face jail time due to the fact that he has not paid child support and has not filed a modification based on his medical condition. The hearing may be continued if court appointed counsel is provided. Your son should also look in to disability.
