my son died while in stat custody and foster parent was taking son to work in a hospital while he was seriuosly ill

I'm not quite clear as to your question. If there was some negligence on the state's part while your son was in their custody, than that is actionable. As for any negligence on the foster parent's part you don't provide enough details. In fact, it would be helpful to know more about the circumstances of your son's death in general.
