Can we request copies of all records from nursing home relative to my mom's rehab?  If so, how long do they have after the request to provide?

My mom received substandard care at a nursing home, having been sent there from the hospital. We want all copies of her records. and want to know what we need to do to get them. Also how long is the wait? What is the law about family asking questions as I was refused answers even though my mom (completely of sound mind) told then to tell me and include me in everything?

I  am a lawyer in CT and practice in this area of the law.  The hospital should be able to get your mom the records within a few days.  there is no set rule that i am aware of for purposes of a time limit.  However, if you go to the hospital you can obtain the records that day or within 3 days or so depending on how much there is to be copied.  More importantly, you are having an issue getting information as a result of the HIPPA laws.  Unless your mom provides a written HIPPA release document to the hospital the hospital is required by law to refuse to provide you information regarding your mom's health.  I suggest that you mom provide you with authorization so you may obtain the records and i would hire a lawyer if you continue to have trouble.
