Can my landlord kick me out before my lease is up if I have paid my rent on time?
Question Details:
My Landlord wants to give my apartment to his daughter by August. I still have 2 years on my lease. He also will not give me a copy of my lease. I have asked for a copy of my lease and he had refuse. I have paid my rent on time for the past 5 years?
If you are in compliance with your lease and there is no term or condition which gives the landlord an early termination right, then you can't be evicted while the lease is still in force. (And note: even if there is an early termination clause, the landlord can only terminate in full compliance with its tems.) The landlord does not necessarily need to give you a new copy of the lease, but if he does try to evict you, at that time, in and for court, he'll need to produce it.
If the landlord wants you out, he should make it worth your while: he can try to offer you key money, find a new, either better or less expensive rental for you, etc. But if you have a lease and you're in full compliance, he cannot simply kick you out.
