What to do if my insurance expired and I hit someone?
Question Details: The damages were just some scratches. My insurance expired, unkown by me. When my ex-insurance let me know I didn’t have insurance anymore, I left a message for the woman, whose car that I hit, to call me back and I would pay for the car if she got an estimate. I then immediately got new insurance. I know this new insurance will not cover what happened but I wanted to know if there is anything else I can do at this point? I am hoping to not have to go to court over this if at all possible.
Unfortunately there is not much you can do. Most insurance companies have a zero tolerance policy so if your insuance is cancelled for any reason, whether you are aware of not, they rarely retroactively reinstate policies unless you can show the cancellation was due to the fault of the insurance company. You are liable for the damages you caused in the accident so offering to cover those damages is a good way to handle that and head off any legal problem in the future. Since it does not sound like the police were involved, it is unlikely that you will receive a citation for failure to carry insurance. Good luck to you.
