My husband recently passed away, how do I get his car title put into my name?

Dear Inquirer:  In Ohio, you may apply to the Probate Court for a Release of Assets Without Adminisration.  Other real or persojnal property of the estate of your late Husband, unless below the statutory limit of $35,000.00 may necessitate a complete filing of all estate asssets for the transfer of real property (real estate) and bank accounts, stocks, bonds, retirement, life insurance, etc.  Consult an experienced Attorney to assist you.

As surviving spouse, you can transfer the car into your name by filling out an affidavit and at the your County Clerk of Courts Title Office with a death certificate and the original title and paying a title/notary fee.  Once transferred, you need to register the new title into your own name at the deputy registrar license agency.  The automobile is not considered an estate asset.  If there are other assets titled to your husband, you may need to open a probate estate to transfer those assets.  If you need further assistance, please contact my office at:  http://www.socrateslegal.com .  Good luck!
