Can my husband have me removed off of the lease without my consent?
Question Details:
I'm having personal problems with my husband and I'm pregnant. He is trying to remove me off of the lease agreement in order to change locks, what are my legal rights? And if he can, how long will it take for him to do that?
You have a possessory interest in the property if you are listed as a tenat on the lease. If you have a possessory interest in the lease, your husband cannot simply remove you becasue he is upset with you and wants a divorce. Indeed, not judge is going to permit your husband to take you off the lease against your will. Furthermore, as long as the lease is still in effect, your husband cannot change the locks and kick you out. You have a right to live there. if your husband is not happy, then he should leave, not you. Plus, you are pregnant and he should make sure you are safe for the sake of his child. I suggest that you call the police if you are locked/kicked out of the apartment.

Are you a lawyer?
