My husband is on parole for 2 degree statutory rape. His PO gave him 4 violations for links that he did not mean to hit while doing some research.

Question Details: He was given a 6 year sentenced and served 2.5 years was let out on good behavior on 11/06. He has 5 more months remaining on his parole. Two weeks ago he was looking for an animation director that did a couple of movies when he was a kid. Long story short some of the links brought up some directors that did XXX animation movies. He has to take a lie detector test sometime in Dec? If he passes she told him she would recommend his parole not be revoked. Will he have to serve his remaining 3 years? Should we look in to hiring an attorney? He has been a upstanding parolee this was a mistake

Criminal Defense Law Answers

Although I do not practice law in the State of Missouri, here are my initial impressions.  The short answer to your question is YES, he definitely should hire an attorney.  Based upon the facts that you have provided, your husband is exposed to potentially 3.5 more years of incarceration if he is violated.  If he takes a polygraph and fails, incarceration will become a true reality, especially due to the fact that the violation was for conduct similar to his initial charges.  He definitely needs to retain an attorney prior to doing ANYTHING else with respect to this matter.  Good luck.
