Question: Real Estate - Texas

Asked on 11/12/2009

How do I sell a home when my husband's Will left his half of the house to his 13-year-old daughter in trust?

Will was submitted to probate and filed for no administration. Husband's first wife (mother of daughter) agreed to award me 100% of home on order. However, title company wants will, which states trust should be set up until child is 21. I want to sell home, how do I do that?

I would have to read the will. Typically, if the matter is "in trust" then a trustee is appointed, and the trustee would have enumerated powers. One of the powers would be the ability to sell the house, and put the proceeds into the trust account, for the benefit of the child. If not, you can establish a trust or manage the child's assets pursuant to the probate code.
