My husband and I are separated and have not filed for divorce yet. How can I protect my credit on the bills that he is supposed to pay?

Question Details: I moved out of the marital house and am renting a house. My husband still lives in the house - that we both still own - and has agreed to pay the bills for the house. Is there something I can do right away to protect my credit if he does not pay the bills on time. We have not filed for divorce yet because I do not have enough money at the moment to pay a retainer and I think he is going to fight me on a few areas.

In N.J. and in most states, your credit can not be affected by your husband unless you are on the credit contract, loan, or credit card.  That is, you would have had to sign along with him.But that does not fully answer your question. First, get this agreement in writing and signed by both of you.  It is preferable that this is done by an attorney but it important that  you have a written agreement asap.   Another problem comes up with with your mortgage on your home or the loan on a car,(if you both signed  In these difficult times, mortage companies are filing foerclosures without waiting. this can affect your credit.  If this is going to continue to create worries and problems, yes, filing for divorce and getting him into court is the best advice I can give.
