My former employer has not sent me my last paycheck what can I do?

Question Details:

Since I quit I have spoken to various managers about receiving my paycheck (for about 2 months now). They each assured me they resolve the matter and I would receive the check and nothing has been mailed to me. Also while I was working there the company repeatedly violated ca. labor law by not allowing employees to take their meal breaks. During this time a manager told me in confidence that what the company was doing was not legal. This is a major retail chain and one of the largest private companies in the U.S.

You have two choices:  you can file your wage claim with the California Department of Industrial Relations (DIR)'s Division of Labor Standards Enforcement, which won't cost you anything, and you can download the forms for this (both the unpaid wages and, if you want to pursue it, the meal break violations), from the DIR website (from the DIR home page, in the "I want to" list on the top left, click on "File a wage claim").  There's no cost for this.  However, you might get faster results by hiring a lawyer and suing (if the threat doesn't get what you want), although that's not free.
