I don't know the facts of your case or the reason why your mother has custody of your children. But in deciding custody, the court/judge considers what is in the best interest of the children. In your case, a judge might consider the fact that you are married as a sign that you can provide a stable, safe and happy home for the children. Of course, the court will probably want to know the background of your new husband.
