Question Details: My father had a car accident and rear-ended a woman. He came out to check on her, she now claims he had malicious intent. He is being sued by her. He has just passed away. What happens to the suit?

The suit can continue despite the fact that your father passed away. If the woman wins a judgment, the judgment will be against your father's "estate." However, she may decide to drop the lawsuit if she feels that she will be unable to collect on a judgment and the time and cost are not worth it.
