What are my rights to child support if my ex is on my son's birth certificate event though he is not the biological father?
Question Details:
My son was born in 1998, no name was on the birth cert and in 1999 I met my ex-boyfriend and he raised my son since he could talk. My son only knows him as dad. In 2003 he signed the birth cert knowing he was not his biological father. Now we have broken up andhe is yo-yoing my son. He is now having another kid due in March and he pays no child support to me and I want to protect my son.
What are you hoping to protect your son from? The state will not permit you to terminate the current father's rights simply because he hasn't paid child support. Have you sought a child support order from the Court? Your ex-boyfriend attempted to become the father by circumventing the state's adoption laws. Are you looking for child support from him or the biological father? You should speak with an attorney.
There are a couple of legal matters.
I do not agree with the prior opinion. Your ex could have become a de facto parent.
It is unclear why you woule want to press your ex-boyfriend knowing that he was not the biological father with child support. Maybe you can explain?
