My ex and I have a parenting plan that is signed by a judge; most of the time we don't follow it because we agree. Is child custody a civil matter?

It is a civil not criminlal matter. The fact that a parenting plan has been signed do off by a judge also means that this is not just a personal matter.  If there is a deviation from it, than either party may make application to the court for enforcement of the court approved plan.  One party's violation can constitute contempt of court. This is punishable by a hefty fine or jail time.
