The person who gets the insurance proceeds from the totaled car under insurance law in all states in this country would be the person in whose name the insurance policy was taken out for concerning the vehicle that you are writing about.

Meaning, if your name is not on the insurance policy for the car that you were on registered title to that was destroyed, you would not be legally entitled to any paid insurance proceeds for its fair market value. If your name is on the insurance policy, then you would be entitled to a portion of the insurance proceeds.
