What are my rights if my doctor sent me incorrect information regarding medical tests?
Question Details:
A few months ago I went to an annual check-up, I was notified there were abnormal results so I went back for a follow-up exam. Shortly after I received a letter from the doctor's office stating that my results were normal and to plan on coming in on my next scheduled appointment (which would be in a year). This letter had my doctor's signature stamped on it. Now she is calling asking if I was notified about my abnormal results and saying I must call her back to handle this. Can I sue?
Failure to diagnose or misdiagnose can indeed be a type of medical malpractice. Here it appears that they caught their error after a certain amount of time. The issue may be if the amount of time between the letter and the phone call was significant in the treating of the condition to cause detriment to you. I would go and seek help from an attorney in your area that does medical malpractice. The consultations are usually free. Make sure that you are aware of the statute of limitations as well. The statute in Michigan is two years generally but can be extended (tolled) under certain circumstances. Good luck.
