Who inherits my dad's house if there is no Will?

My dad owns a home in which I live in. He is now in a nursing home and disabled. If he should pass away what happens to the home?
i am a licensed MD attorney. if your dad passes away, the house would go to his estate and someone would have to go to court and "open" the estate in order to distribute the assets according to MD law (i.e., to spouse then children, etc). it would be best if your dad got a will done now spelling out what he wants to happen to the home when he dies. If you dad passes away the home will become an asset of the estate. If there is no will and your dad is not married, then the home will pass to his heirs in equal shares. If you are the only child the home will likely pass to you. However, if your dad is in a nursing home on state care, the state may take the home from him to satisfy and monies that the state paid for his care. If he is not under state care and is paying the bills at the nursing home then you will likely get the home. Nevertheless, you need to contact a lawyer to talk about which situation exists so that you can plan and know what will happen if your dad passes away.
