My company has hired an individual who retired from a competing company. Can his former company take legal action against him to prevent this?
My company is considering hiring this individual on a consultant basis for a specific program. He will be working part time. His former company is based in Germany, however, he was employed by their division in the U.S. They are threatening to take legal action and withhold his pension

We have not yet verified this person is an attorney.

If there is a covenant not to compete they have recourse against him. Weather they can with hold pension is another matter.
