my car was totaled by a driver on a permit who was out past state curfew laws and he did not have a parent with him. can i sue him and his parents?

I am a lawyer in CT and practice in this area of the law. You are able to sue the kid and the parents under the permissive use doctrine. this means that the owner of the car is liable for the kid's negligence. The owner's insurance policy is going to cover the damages and any injuries you sustained. I suggest obtaining a lawyer to get involved here to protect your rights if the insurance company does not pay the claim in full.
