My car was parked and someone ran into it. The driver at fault is not insured. Can I take that driver to court?

Although you can sue the driver, the problem is that uninsured drivers most likely have little or no assets for you to recover.  If you get a judgement against that uninsured driver, you might not collect anything.  If your auto insurance policy includes uninsured motorist coverage, it would be preferable to file the uninsured motorist claim under your policy in order to be compensated for the property damage to your vehicle.
