Question: Criminal Defense - New Jersey

Asked on 10/28/2009

My car has been stolen 3 times in the complex that I live in. We have security and cameras everywhere. Do I have a case?

I have asked the landlord each time to look at tapes and see who keeps stealing my car. I have not got a response not one time. What should I do?

Have you contacted the police department in your area? If you haven't, you need to do that as quickly as possible. Very often, if not most often, the videotapes you are referring to have a limited life or the video cameras have no tape at all. You need to report these thefts to the authorities and tell them about the existence of these video surveillance/security cameras. Perhaps your landlord is nervous because his surveillance cameras have no film. There are many possibilities.

Although I do not practice law in the State of New Jersey, here are my initial impressions.  There seems to be something missing from this story.  First, you state that your car has been stolen not once, not twice, but THREE times, but then you fail to mention whether you have reported any of these incidents to the police?  Obviously, the police could get a warrant for the information that you seek.  Second, how have you gotten your car back each time after it was stolen??  Obviously, there is more to this story then you have let on.  Please write back with more information.
