My car got hit by a rental truck while my car was parked on a street; the truck driver does not have insurance

Question Details:

I am from VA and visiting NY, my car was parked on a street parking while it was hit by a rental truck, however, the driver was not the renter and she does not have insurance (she was helping her friend to park the truck). Who is responsible for cost to fix my car - the rental company, the driver, or the insurance company of the renter (who owns a car)? I am not sure if the renter purchased rental insurance from or not.

I am a lawyer in CT and practice in this area of the law.  You first need to obtain the contact information for all these parties that you mentioned (i.e. the rental company, and the insurance company of the renter).  These are the entities that are likely on the hook.  send them a copy of the police report and you contact information.  one or both of them will call you to work out the mess.  The renter's insurance will likely be responsible for paying this and will be contacting you.  make sure to follow up 3 days from the date of your letter.
