Rights of deceased's owners heirs
Question Details:
My brothers and I inherited a home from our parents. After my brother died we sold the house. Do his kids have any right to claim part of the property?
At such time as your brother inherited his share of the house his rights became vested in it. In other words, he legally become one of the owners. As such, whether he died before the house was sold makes no difference. His estate is entitled to his share of the proceeds from the sale. Either his beneficiaries if he died with a Will or his heirs if he died intestate (without a Will).
