The decision as to what charges to bring is made by the prosecutor's office for the county where the accident occurred. As to sentencing, the Court will determine that and will take into consideration the prior record of ofenses that the driver has had. The family of the victim is usually allowed to address the Court at sentencing time.

I'm not a Michigan lawyer, but my research suggests that on the single charge of killing someone while driving while intoxicated, a person faces up to 15 years in jail, and a fine of up to $10,000.

Exactly what this person will get, I couldn't say.  There are a number of things that go into criminal sentencing.  There could also be other charges against the individual, and his prior record, if any, would also be a factor.
