Question: Wills, Trusts, Probate - South Carolina

My boyfriends ex girlfriend who he had 2 children with now wants custody.
My boyfriend has had custody of his daughters for about a year now. His ex girlfriend, who is the mother of the girls, hit him across the face repeatedly and he called the cops on her and she was arrested a year ago and is currently going to classes. She now wants custody of the girls but she has no income, no method of transportation, and still lives with her parents at the age of 21. He however has a job with the state, lives with the girls in a 2 bedroom apartment, has two cars, and no criminal background. What are her chances of winning custody?

I am a lawyer in CT and practice in this area of the law.  The chances of a court giving her custody is slim as the court is going to determine the custody issue as to what is in the child's best interest.  if the ex does not have a job or positive/healthy environment to care for the child then the court is not going to let her have custody.  however, th court may permit the ex to have certain visitation rights.  However, i suggest that these be supervised and you should have the guy hire a lawyer to represent him in this to further show how he is the better parent - i.e. seeing that the guy has a lawyer says a lot.
