Question Details: We both have no money and are looking to get married, not looking to necessarily get out of this free but want a start in a positive direction to make like better. I know his debts become mine. My boyfriend had some mental issues about 5 years ago he was stopped for a DUI and has no drivers license. He also has a debt of about $60,000 or so from medical bills. He also has a suit for disibility thru a medicade specialist company to help get his disabilty. They told him it would take 2 years to get an answer. What is the best way to go about getting things resolved?
There is no way to get a "clean start" as far as his DUI. There is something known in the law as "expungement" ; this will essentially clear a criminal record. However, in Michigan the statute governing expungement specifically precludes a person from even seeking to have a conviction for a "traffic offense" (including drunk driving) set-aside. The statute also precludes a Judge from setting aside such a conviction.
However, the good news is that his debts don't become yours once you become husband and wife. As long as those debts were incurred soley in his name, marriage does not make you automatically liable for them. As for those medical bills, perhaps your boyfriend might be a candidate for bankruptcy if he has no hope of paying them off.
Right now he should consult with an attorney in his area specifically as to all of this.
