If my boss, who was recently fired, is now trying to contact me for information, am I obligated to disclose this information to my employer?

Question Details:

My boss was fired last week. A few hours after he was terminated, he contacted me asking me to log into the computer system under his credentials to download some information for him. The information he believes will help him build a case against the company. I declined. Ever since, he has been trying to call me every day, even at work. I am certain it is in regard to his continued effort to build a case against the company. I have not taken his calls. Am I obligated to report this to the company? I assume I should probably not return his calls, even if I were to avoid talking company business.

There is no legal obligation to inform your company. What you need to ask yourself is: (1) how likely is it that they will in some way find out that your old boss has been contacting you, and specifically, what he has been asking; (2) if they do find out and you had not previously disclosed the contacts, what will be their reaction; and compare that to (3) what will be their reaction if you do disclose the contacts? Remember, that a company may fire someone at any time, for any reason (unless there's a contract), so you need to do what you think will best protect or position yourself.
