Is it legal for a 16-year-old to date and have sex with a 40-year-old?
It appears that under New Hampshire law, as long as your child is in fact 16 or more (so, they had their 16th birthday), it is not against the law. If they were under 16 when the sex started, that might have been illegal and should bring it to the attention of your local police.
Here are some citations to the relevant New Hampshire laws:
New Hampshire Revised Statutes, § 632-A:3
New Hampshire Revised Statutes, § 632-A:3
