My 14-year-old son has a hearing for on a lewdness charge, how can we best handle this?

Question Details:

A 14-year-old girl twisted my son's nipple so he twisted her's. They were playing around in school gym class. The teacher says it was consensual. We have a meeting with a probation office next week and then a hearing the week after. We filled out an affidavit of Impecuniously, to have an attorney appointed. We have not been able to get a copy of the police report. The detective will not release it. He is waiting for something from the DA's office. Please let us know what we can do.

While the two kids were playing around, schools are cracking down on behavior like this and making the kids culpable regardless of whether they were joking around.  The penalty for a crime such as this is generally a nominal fine (not more than $200) or resolved by suspending the two kids from school for a few days of making them do some kind of community service.  because the kids here a minors the court is going to have a closed off proceeding so the public cannot attend the court and watch.  the idea is to keep the identity of the kids private.  You did the right thing by applying for a court apointed lawyer.  once you have a court appointed lawyer the lawyer will be able to review the state's attorney's file. the file will include any statements make by the teached, other students and a copy of the police report of the incident.  Make sure you attend court with you son and aks questions to the lawyer.  Insist that your lawyer make you copies of the file that the state has.
