Moving from North Carolina to New York with DWI charges pending.
Question Details: I was arrested for DWI in my current homestate of North Carolina but am in the late-stages of moving to New York. NC will give me my license back until trial shortly (After 30 day suspension ends) Is there any benefit of getting a NY license before I go to trial in NC? I will deal w/criminal aspects in NC but if I leave my license w/NC it will be revoked for 1 year. I am guessing NY wd get notified by NC after my eventual trial/conviction so don't know how to remedy. I want to deal with New York moving forward, even if they suspend my new license after NC convicts me. Pls help !!
If you are convicted of a DUI in NC, NC will suspend your driving privileges, and assuming that NY reciprocates (I'm fairly certain it does), you would face suspension in NC, which would be honored in NY.
However, most states grant limited driving privileges, and you'd have to find out whether and on what terms you'd qualify for limited driving privileges. Generally, these limited driving privileges permit you to travel to or from work, to or from school, or if you're a homemaker, allow you the privilege to drive during the day.
Some states require an interlock device be installed in the car, depending on what you blew when you were arrested for the DWI.
You should certainly try to get an attorney in NC to try to prevent a conviction on the underlying DWI charge. If you can avoid a DWI charge, you avoid the bad consequencs in NY as well.
