If a motorcycle hits single passenger car in carpool lane from behind,who's fault?
Question Details: A motocycle was sharing/splitting lanes and hit a car in the carpool lane. The car in the carpool lane had only a single rider and was illegally in that lane. Normally it would be the motorcycle's fault, but under these circumstances would the car in the carpool lane automatically be at fault for being illegally in that lane?

Not necessarily. The fact that the HOV violation under the circumtances has nothing to do with the collision. The HOV lane is to encourage road sharing, not to prevent accidents.
