You need to ask an attorney who is licensed in Colorado this question as it pertains to Colorado law and the law is different from state to state. I would recommend you call Lance Sears in Colorado Springs. He is an excellent personal injury lawyer and has won many substantial settlements for his clients and has been very active in the various trial lawyer organizations.
You should tell him that I suggested that you call him that way he will speak to you sooner.
