Question: Employment and Labor - Tennessee

Asked on 11/5/2009
Medical discharge from Military
My Granddaughter is getting a discharge because she did not disclose past medical treatment that she no longer takes meds for. Her recruiter told her not to mention them at boot camp and in moment of truth it came out, now she is being sent home on fraudulent medical discharge. She was lied to and promised things that didn't happen and was told to withhold info. She want's to return for a career in the future, what should she do to defend her character and future?

Your grandddaughter should contact the office of the Judge Advocate General (JAG), which is the legal services part of the military.  JAG lawyers prosecute courts-martial, but they also represent soldiers in courts-martial and other disciplinary proceedings.  I'd hope that as in the civilian justice system, there is a way she can appeal this decision and get a hearing, to explain her side of the story;  whatever recourse she has, the JAG attorney will know what it is, and the services are free.
