Medical Debt Collection on un-probated Will.

Question Details: I reside in Texas. My Grandmother passed away in October 2008. Because her estate had a value of only a few thousand dollars, my Aunt, who was in charge of my Grandmother's estate, decided to save money and not probate her will. All assets in this Estate were settled months ago. Now my Aunt has received a medical bill for my Grandmother's care demanding payment. Is anyone responsible for this debt?

You don't say what authority your Aunt relied on to settle the estate. For purposes of this answer, I assume that she merely distributed your grandmother's assets without a court order. Under that circumstance, everyone who received any of the assets is vulnerable to a claim for that portion of the medical bill equal to the value of the assets received. Your Aunt may be exposed to a greater liability since she took it upon herself to dispose of the assets without legal authority.
