Maternity leave and the small business
Question Details: I work for a small business of under 35 people and the company makes less than 1 million a year. I was told that during my materinty leave they were not required to hold my job and that they did it only as a curtosity. Is this true?
Not necessarily true, but an attorney would need a little more information about this business and specifics of your situation. For instance, how many employees exactly? There are both federal & state laws that deal with pregnancy discrimination and some are based on the size of the employer. (Including the Equal Pay Act) However, if your job was in fact held for you, it sounds like you are just curious and not examining a potential claim? You may wish to contact the EEOC.
That's correct. The Family and Medical Leave Act only applies to companies with 50 or more employees. See http://www.dol.gov/esa/whd/regs/compliance/whdfs28.pdf.
(The logic is that smaller companies might find it impossible to hold a job position open w/out hurting their operations or business.)
