How long does a DUI stay on your driving record?
Question Details:
Massachusetts
For ever, unless sealed.
Such a conviction regardless can be used against the convited person for ever.
From what I have read it appears that it stays on your record for approximately 5 years on a point system but check with a local attorney to be sure. You can also check with the RMV. If you want to check the status of your license here is the information. Unfortunately, you cannot order a copy of your Massachusetts driving record online. This leaves you with the following options: Order by phone: You can call the RMV telephone center and use a MasterCard, Visa or Discover card. Order by mail: Mail your check along with the completed form to the following address: Attn: Mail ListingsRegistry of Motor VehiclesDriver Control UnitP.O. Box 55896Boston, MA 02205-5896 Order in person: Go to your nearest RMV office and pay by cash, check or money order. The fee for a copy of your driving record is $20. You should receive the record by mail about 10 days after you order it. Certified copies are only available through the mail by sending the appropriate form to the address listed on the document.
A DIU stays on your driving record forever. However, for sentencing purposes the court will only look back into your record for 5 years; accordingly this is known as the "look-back" period. If you has another offense within that time than this offense will be considered to be your second (or third, etc). Otherwise, if you have had no other offenses within this time period, this most recent offense will be treated as your first for the purposes of imposing a penalty.
