Malpractice, unneeded operation
Question Details: Hello, my name is Tamera. I had an operation done about 2 months ago. The operation did not work, so I decided to get to do as much research on my condition as possible. I found out that what I truly have is not what he told me I had. I talked to him about his, and I explained to him that I told him over and over again my symptoms (and the symptoms are similar but different). So I asked my doctor why he STILL wanted to have the surgery done, and he just said “I thought that’s what your symptoms were.” I had told him in over 6 visits over and over again the actual symptoms I was having, and I guess he choose to hear what he wanted to hear. And he did say that the operation would NOT treat my actual condition, then did not want to discuss it anymore. So all in all he went ahead and did an operation on me that was NOT NEEDED, and wants me to pay for it. Also The pain has gotten A LOT worse sense the operation. What can I do?? Please help, I am still in A LOT of pain and need some advice!
The very first thing you need, if you haven't taken care of it already, is a new doctor, and get started on whatever treatment you need from here.
Then, see a lawyer who does medical malpractice cases, either someone in at least a medium-sized firm or someone who advertised only for malpractice, or at most only for personal injury cases. The lawyer will have you sign a release so they can get your medical records and review them, before filing suit.
Please do follow up on this. Proving malpractice can be very involved, and most cases that get anywhere near trial end up being largely a "battle of the experts," with the injured person's expert surgeon saying the doctor was negligent, and the doctor's expert saying he wasn't. But from your outline of the facts, this might be a very strong case.
