Lying in mediation

Question Details: During mediation, one person lied about his financial situation as he was negotiating a price for land left in a will to him and his siblings. His siblings gave him a low price. Now it turns out he lied and could afford more. Was it illegal for him to lie?

Lying under oath is called perjury.  If they entered in to the settlement agreement during mediation based upon his representations they could try and move to set aside the agreement based upon his misrepresentations.  It all depends on the parameters of the mediation and your state law.  It is best to seek legal advice on this matter from an attorney near you.  The cost and trouble of going through rectifying the situation may not be worth the increased amount he would have paid. An expensive lesson nonetheless.
