Life partner remained in home under terms of will. Will states he is responsible for insurance and taxes but refuses to pay. Can he be evicted?

Question Details: The house and contents were inherited by son and all other assets were given to life partner. Family agrees with terms of the will but do not want the burden of insurance and tax payments. Partner has inquired about selling off home assets inherited by son. My husband has given his permission and told him to use the money to pay us back for the insurance and taxes. Still no repayment. The home is located in California.

If the will left the assets to the son, and the life partner has a life interest, but does not perform the responsibilities provided and required in the will, then the "owner" can evict the life partner.

There are notice procedures involved before proceeding with any eviction.
