Life Insurance Will (MOM) vs. Divorce Decree (EX WIFE)

Question Details: My step father died recently and in his will it stated my mother was the full beneficiary of his life insurance. Now in the divorce decree he made with his ex it stated that as long as child support was made it would go to the kids in a trust but not her, but he was not paying child support he was on disability with the kids getting social security from it, when he changed the will stating that my mother was the beneficiary. But the Ex is fighting back and taking my mom to court, even though my mother still wants to create a trust for his kids! His ex-wife wants it all for herself.

The insurance policy and the current named beneficiary on the insurance policy may determine who gets the life insurance policy proceeds.

Your mother needs to retain the services of an attorney ASAP if the EX is suing her mother and taking her to court.
