After a death what legal steps need to be taken regarding the estate (probate, expenses, etc)?

Question Details:

My biological brother passed away yesterday. I've only met him once and had no relationship with him, but he has put me down as emergency contact/next of kin. I was pressured in making a decision to choose a funeral home to pick up his body and now have no idea what to do next. I don't have the money for all the incurred costs of cremation, burial and legal fees. What steps would I need to take to take care of his estate? And am I responsible for his debts? He has no money or will, that I am aware of. I really don't even know what questions to ask.

If your brother has no money, there won't be any probate because there isn't any estate.  You are NOT liable for his debts.  Do NOT be pressured by credit card companies contacting you regarding his debts.  Again, you are NOT liable for his debts.  However, the funeral parlor will probably require payment prior to burial.  If you have other relatives, who might be able to help with the funeral expenses, that would probably be the best option under the circumstances.

Since your brother did not have a will, intestate succession (dying without a will) determines inheritance.  If your brother did not have a wife or any children or other siblings and since you are listed as the next of kin, you would be the beneficiary if there is any inheritance.
