Question Details: I live in Florida. Both my husband and I paid for separate consultations with the same attorney regarding a matter not having to do with our divorce. My husband later hired him. I did not hire him, as the info I gathered from the consult was all I needed. Since he engaged in a business transaction with us both, can he now represent my husband in our divorce proceedings, or would that be a conflict?

It is possible that this could be considered a conflict if any information was gained during your consultation that could potentially disadvantage you in any way during the divorce proceedings. Have you brought it to the attorney's attention? You can also file a motion to disqualify if they won't voluntarily remove themselves if you feel it is a conflict of interest.
