Question Details: A friend of mine is on probation for a DUI and living outside of the state they are on probation in without permission from their Probation Officer. The friend no longer has any living options in the state they are on probation in. What would be the penalty if caught? Should the friend come clean with their Probation Officer?
Although I do not practice law in the State of New York, here are my initial impressions. While I cannot advise anyone to lie to an officer, I can tell you that if the probation officer finds out, your friend will risk having the probation violated, which may trigger a period of incarceration. Your friend should do everything he/she can do to comply with the conditions of probation. Good luck.
