Question: Personal Injury - New York

Asked on 11/6/2009
lawsuit settlement delay
Been waiting over 35 days now. Can I find out exactly what the settlement terms are in regard to paying the claim. Signed paperwork acknowledging settlement, but nothing is there stating how long it will take to get paid. This is no-fault case vs. taxi driver and myself (pedestrian). Case took over 4 years before settlement reached. Will payment take as long?

You should have been informed of the settlement terms prior to agreeing to the settlement.  The terms of the settlement should have been known to you prior to signing any document pertaining to settlement.  Your attorney should provide you with information regarding the settlement.

Payment of the settlement should be without delay.  Ask your attorney why the payment of the settlement has been delayed.  Your attorney may need to contact the opposing counsel to find out the cause of the delay in payment
