Question: Employment and Labor - Texas

Asked on 11/6/2009

Laid off - when does health insurance end?

I was laid off last week, told I had 1 month left on my insurance. This week I got an email from my previous manager saying that due to Senate Bill 51, all health insurance ends the SAME DAY that an employee gets laid off. I received paper work in the mail from the payroll company/insurance saying I was covered for another month. I emailed my manager to tell her this, she emails me back with a fwd from their Broker AND payroll company saying I am not covered as of the day I was laid off, end of story. Is this a new bill that passed? Now I have to pay $300/month for me w/o a job! What to do?

Unfortunately, health insurance is an employment benefit, and unless there is an agreement to the contrary (e.g. a severance agreement), it ends when employment does. You can of course continue it through COBRA, in which case you will need to pay the employer's share of the premiums as well as the employee share. Where there might be some confusion is that you do not need to elect COBRA the day you are laid  off; you have a grace period during which to select it, and if you do, the coverage is retroactive back to your termination.
