Is there anything I can do?

Question Details:

I was in a car accident a week ago. I was rear-ended by another driver. His insurance company will not provide me with a rental car because Ionly had liability on my own vehicle. They will only pay the liability fee towards the rental car so I would need to pay the difference out of pocket. The only other option they gave me was an allowance of $25 a day which I was able to get them to raise to only $28 a day. I'm 19 years old; I work and go to school. I need a vehicle. It was not my fault that Iwas rear-ended and I feel that I am being taken advantage of.

Even though the accident was not your fault, the at-fault driver's insurance company has no legal obligation to you.  That is because you have no contract with that company.  The at-fault driver's insurance company only has an obligation to protect its insured (the person that hit you).  If the insurance company isn't willing to pay what you believe was fair, you should retain an attorney and file suit against the driver of the car.
