Is there a statute of limitations for submitting invoices?

Question Details:

The company I work for used to subcontract work to a vendor back in 2003-2005. This vendor did not invoice us at that time for any of the work performed. We subsequently performed several similar jobs for them in 2007/2008, billed them within 30 days and they refused to pay. They claimed that we owed them more than they owed us. We took them to small claims and lost, based on "proof" in the form of invoices they dated 12/22/06 that had never been sent to my company until just a few days before our court date in 01/09. Is there a time limit a company can invoice for work performed?

In legal terms here I am assuming that you had a contract with the vendor.  In Massachusetts the statute of limitations for suing on a contract if it is written and under seal is 20 years. Otherwise, 6 years.  Here when the statute started to run would depend on certain elements of the contract, like when the job was completed and the term of the contract (you gave a 2 year time frame for the work).  If you use the outside date of 2005 then 2011 is the time limit.  The fact that they back dated them is not the coolest thing so I would keep the envelope they came in and take the contract to an attorney to review.  Although now that the issue was litigated you may be precluded from doing anything.  Has the appeal time run?  Seek help soon.
